Auto-Ship Program Terms & Conditions

Terms and Conditions

Welcome to the Terms & Conditions for our Auto-Ship program (the "Program" or "Auto-Ship")!

• These Terms are between you and Medwing.com Inc. and/or its affiliates ("Medwing", "Us", or "We").
• This is the entire agreement between Medwing and you - there's no extra fine print.  All rights and obligations that have to do with Auto-Ship are listed here.
• If you place an order through our Auto-Ship program, you accept these terms, conditions, limitations and requirements, so please read them carefully.

How Auto-Ship Works

• When you register for an Auto-Ship subscription for a particular item, the first order will begin processing immediately and your credit card will be charged for the price of the item plus tax and shipping.
• Credit cards are the only payment method we currently accept for Auto-Ship orders.
• Auto-Ship reorders are available in one month, two month, three month, six month, and twelve month intervals. You choose how often you want to receive your item, and Medwing will automatically send it to you on that schedule using the shipping method you select during Auto-Ship registration.
• You can change your shipping address, e-mail address, and phone number associated with the Auto-Ship subscription at any time online in the "Edit Account" section of "My Account."
• You can change the delivery frequency, item quantity, shipping address, payment method, and billing address for your Auto-Ship subscription by calling the Medwing customer service department.  CHANGING YOUR BILLING AND/OR SHIPPING ADDRESS IN THE "EDIT ACCOUNT" SECTION DOES NOT CHANGE THE INFORMATION ON YOUR AUTO-SHIP SUBSCRIPTION.  You must call customer service to change this information!
• You can view your order history, including any open Auto-Ship orders, in the "Order History" section of "My Account."
• Each subsequent reorder of your Auto-Ship item will be processed during the same 3-day period of the month.  Each new shipment will appear on the "Order History" page in "My Account."
• You can cancel your Auto-Ship subscription for any item by calling the Medwing customer service department.  You will not be charged for any future orders, and no additional items will be shipped to you.

Conditions

• You must have an account with Thermophore.com in order to sign up for Auto-Ship subscriptions and purchase items through the Auto-Ship program.   Your Auto-Ship subscription is personal to you, so you may not assign or transfer your Auto-Ship subscription (or any of the benefits associated with Auto-Ship) to any one else.
•  We reserve the right to accept or refuse Auto-Ship orders at our discretion.  (But we probably won't!)
• If there are problems with payment, shipping address, or other account information, we will contact you via e-mail using the address associated with your account.  We won't process or ship any further orders until the problem has been resolved.
• If any Auto-Ship item is not available on the day it is scheduled to be shipped, we will let you know by e-mail using the address associated with your account.  We will try to fulfill the order as soon as possible!
• If any Auto-Ship Item is discontinued or no longer available, we will automatically pause your Auto-Ship subscription for that item, and we'll send you an e-mail to the address associated with your account; no additional orders will be placed for that item.

Agreement Changes
We may, at our discretion, change these Terms & Conditions or any policies without notice to you.


Termination by Us
We may terminate your subscription at our discretion. If we do so, you will only be charged for orders that have already been shipped to you.


Limitation of Liability
IN ADDITION TO THE OTHER LIMITATIONS AND EXCLUSIONS CONTAINED IN MEDWING'S CONDITIONS OF USE, IN NO EVENT WILL WE OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, ARISING OUT OF OR RELATED TO YOUR AUTO-SHIP SUBSCRIPTION OR THE PROGRAM. OUR TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE AMOUNT OF ALL AUTO-SHIP SUBSCRIPTION PAYMENTS ACTUALLY MADE BY YOU DURING THE COURSE OF YOUR SUBSCRIPTION. THESE EXCLUSIONS AND LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE ANY CANCELLATION OR TERMINATION OF YOUR SUBSCRIPTION OR PARTICIPATION IN THE PROGRAM. CERTAIN STATE LAWS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
